The IACHR condemns Colombia for the dismissal of Gustavo Petro as mayor of Bogotá due to the garbage crisis

August 19, 2020

The Inter-American Court of Human Rights (IACHR) has condemned the Colombian state for disqualifying and consequently recalling Senator Gustavo Petro as mayor of Bogotá as part of the garbage crisis.

The IACHR reported Tuesday that on July 8th it “issued a judgment declaring the international responsibility of the State of Colombia for violating various rights to the detriment of Mr. Gustavo Petro”.

The district court claims that “Mr Petro’s political rights have been compromised as a result of the disciplinary sanction of dismissal as mayor of Bogotá and disqualification for a 15-year term from the exercise of a public office imposed on him by the Public Prosecutor General’s Office on December 9, 2013 “.

According to the IACHR, “the norms that empower the attorney general’s office to impose these sanctions on democratically elected officials – as was the case with Mr Petro – are those that have the practical effect of incapacitating them.” Political rights based on a decision by the Comptroller’s Office are a violation of the American Convention on Human Rights.
