The Israeli government announced Tuesday that, starting January 11, it will lift restrictions on surrogacy for same-sex couples and transgender people, previously restricted to heterosexual couples and single women with fertility problems.

The Israeli health minister Nitzan Horowitz issued a circular amending the law on surrogate motherhood following a court ruling in this regard, which grants this right to “all people in Israel,” according to the Israeli newspaper “Haaretz”.

The Israeli Supreme Court ruling lifted the discriminatory definitions in current legislation that excluded some men and ruled that the government had an obligation to guarantee men and women equal terms on this issue.

For example, Court President Esther Hayut stated that the change would allow anyone “suffering from fertility problems of a type and quality that can only be resolved through surrogacy” to benefit from this process while also affecting it would create “complete equality between a woman and a man with a medical problem”.

“Today we put an end to years of injustice and discrimination,” said Horowitz and emphasized, “in a week there will be equal access to surrogacy for single men, future parents and homosexual couples.” “Actually for each individual,” emphasized the minister.

With this in mind, he points out that “members of the LGBTI community also have the same right to be parents”. “From now on we will treat every father and every family equally at the ministry. Everyone has the right to be a father. Transgender people will also have access to surrogacy in Israel, ”he concluded.

Current legislation requires those wishing to resort to surrogacy to seek permission from a ministry committee to see if they can apply for it. An agreement is then approved between the applicants and the surrogate mother.
