Hamas values the decision of the Prosecutor’s Office of the ICP to investigate Israel for war crimes

December 21, 2019

The Islamic Resistance Movement (Hamas) has valued the decision published Friday by the Prosecutor of the International Criminal Court (ICC), which opens a formal investigation into the alleged war crimes committed in Palestinian territory.

“The Hamas movement welcomes the decision of the prosecutor of the International Criminal Court to open an investigation of war crimes perpetrated by the (Israeli) occupation against the Palestinian people,” said a Hamas spokesman, according to the Israeli press

“It is an important recognition that requires concrete steps for Israel to be accountable to justice for its crimes against the Palestinians. It is the principle of the criminalization of the occupation,” he added.

However, Hamas has not commented on the position of the Prosecutor's Office of the ICC that recognizes legal basis for complaints against Hamas for attacking civilians.

The chief prosecutor of the TPI, Fatou Bensouda, announced Friday the opening of a formal investigation resulting from a preliminary examination initiated in 2018 at the request of the Palestinian Government, as a State party to the Rome Statute, the founding treaty of the TPI.

The Gambian jurist has affirmed that “there is a reasonable basis” to think that war crimes have been committed in the West Bank, including East Jerusalem, and in the Gaza Strip, since June 3, 2014.

The Prime Minister of Israel, Benjamin Netanyahu, reacted quickly in a video to reject what he considers an “unfounded and atrocious decision.” “Today is a black day for truth and justice,” he lamented.
