The decision by Onda Digital to adopt OpenTV as an interim measure on its Quiero Digital platform in Spain is being challenged by Socecable in a letter to the Spanish Administration.

In it, they say that the decision to adopt the same proprietary system as is used by Via Digital implies an agreement between the two dominant multimedia operators, Retevisión and Telefónica. Making the assumption that DVB РMHP will become the adopted European public standard, they say that the decision may be in breach of the spirit of EC Directive 95/47 and, at the very least, requires Onda to inform the European Commission under Directive 98/34.

Quiero Television has accepted that it will move to MHP in the long term but there must be a suspicion that these are empty words. Given the continued delays (the 25th February, the planned soft launch date, came and went this week amid rumours that the pilot Sagem boxes just don’t work at the moment) the arguments for going straight to MHP look increasingly strong.

The objection was to be expected, of course, since Socecable use MediaHighway on their cable network. Nevertheless, the arguments they use are logical and would have the full support of manufacturers, other operators and the regulatory authorities both in Madrid and Brussels.
