The Buenos Aires Supreme Court reversed a previous decision earlier this Monday that supported the release of the most vulnerable prisoners to prevent them from getting infected with the corona virus in prisons.
The six judges overturned the collective “Habeas Corpus” of the Vice President of the Buenos Aires Cassation Court, Víctor Violini, which gave green light to the house arrest of inmates over 65, people with pre-existing illnesses and pregnant women.
The Provincial Supreme Court ruled that releases should be assessed individually, taking into account the circumstances of the case, including the seriousness of the crime and the situation of the victim, regardless of the prisoner’s personal circumstances.
In his opinion, Violini’s decision is “something immediate and massive that interferes with the necessary action by the responsible judges”. “The institutional channel must be respected,” the judges said.
